1. Introduction

1.1 Egalite Marketing Pte. Ltd. are the owners of the JobQuest 365 Websites [hereinafter ‘Our Websites’]. Our Websites may be used by all Users subject to their acceptance of our Website Legal Terms, which consists of Our Website User Agreement [Click here], Our Privacy Policy [Click here], and Our Acceptable Use Policy [Click here].

1.2 In addition to Our Website Legal Terms [specified in Clause 1.1 hereinabove], as an Employer, You are also bound by the Employer Agreement [this ‘Agreement’].

1.3 We may revise, change, supplement or amend [collectively ‘revise’ or variants thereof] Our Website Legal Terms and Our Employer Agreement as they relate to Your use of Our Websites and of Our Services from time to time. Any and all such revisions are done by us by our posting the revised documents on Our Websites. You hereby agree that all such revisions shall apply to Your use of Our Websites or of our Services from the date that such revisions shall take effect.

2. Who is considered an Employer.

2.1 A Registered User that advertises recruitments for Jobs, Projects or Tasks on the JobQuest 365 Websites.

3. Password and Security

3.1 When you register to use the JobQuest365.com Website you will be asked to create a password. In order to prevent fraud, you must keep this password confidential and must not disclose or share it with anyone. You agree to immediately notify JobQuest365.com of any unauthorized use of your Account and password.

3.2 If JobQuest365.com has reason to believe that there is likely to be a breach of security, or misuse of the JobQuest365.com Website, we may require you to change your password, or we may suspend your account.

3.3 As a result of the loss of your Password, or the misuse of the JobQuest365.com Website by You, You hereby agree that any and all loss, damage or expense suffered by us shall be borne by you.

4. Additional Terms applicable to Employer

4.1 JobQuest365.com hereby grants you a limited, terminable, non-exclusive right to access and use the subscribed for Services on the JobQuest365.com Website for your internal use. This authorizes you to view and download a single copy of JobQuest365.com Content or Materials on the JobQuest365.com Website solely for your use, which is directly related to your searching for and recruiting Candidates that applied for your Advertisement.

4.2 JobQuest365.com also grants you a limited, terminable, non-exclusive right to use the JobQuest365.com Services for your internal use only.

4.3 You are responsible for maintaining the confidentiality of your Employer account, Profile and passwords, as is applicable to You

4.4 You shall not share your password or other account access information with any other party, temporarily or permanently, and you shall be strictly liable and/or responsible for all uses made of your JobQuest365.com Website registrations and passwords, whether or not authorized by you.

4.5 You shall immediately notify JobQuest365.com of any unauthorized use of your Employer account, Profile or passwords.

4.6 You hereby undertake that any Employer Materials provided by You for use in connection with the JobQuest365.com Services will not violate any Applicable Laws or regulations or third-party proprietary rights, including, without limitation, copyright and trade mark laws, or the laws relating to the publication of obscene or pornographic materials, the rights or publicity, privacy, and the laws of defamation.

4.7 You hereby undertake that You shall disregard any personal data provided by or received from a Candidate which is irrelevant in making your evaluation of and assessing the suitability of Candidate.

4.8 You hereby undertake that You are solely responsible for the Employer Materials provided by you which is placed on the JobQuest365.com Website. JobQuest365.com shall not under any circumstances nor at any time be considered an Employer [or Co-Employer] with respect to your use of any JobQuest365.com Website Services.

4.9 You hereby undertake that You shall be solely responsible for any employment decisions made by You as a result of your use of the JobQuest365.com Website or its Services.

4.10 You hereby undertake and agree that your Employer Materials shall not contain:-

4.10.1 misleading, unreadable, or “hidden” keywords, repeated keywords or keywords that are irrelevant to the job opportunity being presented;

4.10.2 names, logos or trademarks of unaffiliated companies or third parties;

4.10.3 inaccurate, false, or misleading information; and

4.10.4 materials or links to materials that are discriminatory, pornographic, sexually explicit, obscene, libelous, defamatory, threatening, harassing, abusive, hateful, or which solicits personal information from anyone under the age of eighteen (18).

4.11 You hereby undertake and agree that You shall not use your Employer Materials to:-

4.11.1 post jobs in a manner that does not comply with the applicable local, or national laws, including but not limited to laws relating to labor and employment, equal employment opportunity, employment eligibility requirements, data privacy, data access and use, and intellectual property;

4.11.2 sell, promote or advertise products or services;

4.11.3 post any franchise scheme, pyramid scheme, distributorship scheme, or any multi-level marketing opportunity scheme;

4.11.4 promote any opportunity that does not represent bona fide employment;

4.11.5 advertise the provision or procurement of any type of sexual services by any person or which seek employees for jobs of a sexual nature.

4.12 JobQuest365.com does not allow any Employer Materials on JobQuest365.com Website that requires Candidates [or any other persons] to pay any monies, including deposits, placement fees, processing fees or any other similar fees, directly or indirectly, and/or require Candidates to make purchases of any Products or Services from You or any third party.

4.13 JobQuest365.com does not allow recruitment advertisements that advertise more than one position in a single posting.

4.14 Though JobQuest365.com is under no obligation to monitor the Employer Materials on the JobQuest365.com Website, JobQuest365.com may monitor the Employer Materials at random.

4.15 JobQuest365.com reserves the right to remove any Employer Materials or content from any JobQuest365.com Website, which in the reasonable exercise of JobQuest365.com’s discretion, does not comply with our policies, or of any content posted that JobQuest365.com believes is not in the best interest of JobQuest365.com.

4.16 The reposting of the same position by You is allowed only after the post has expired to minimize duplication and spamming of recruitment postings on the JobQuest365.com Websites.

4.17 Job recruitment postings will expire fourteen (14) days after the posted date.

4.18 Project and Task recruitment postings will expire on the following day after the "Start Date" of the post.

4.19 If at any time during your use of the JobQuest365.com Services, you made a misrepresentation of fact to JobQuest365.com, or otherwise misled JobQuest365.com regarding the nature of your activities, or You breach the terms of this Agreement, or of our Website Legal Terms, JobQuest365.com may terminate your use of the JobQuest365.com Account and Services, and in such event, any payment made by you shall be forfeited.

4.20 You understand and acknowledge that if you cancel your Employer account, or your Employer account is terminated, all your account information on JobQuest365.com, including saved Content and Materials, shall be deleted from our JobQuest365.com Databases. Information may continue to be available for some period of time because of delays in effecting such deletion through JobQues365.com’s web servers.

5. Intellectual Property

5.1 JobQuest365.com Website, JobQuest365.com Content, and all right, title and interest in and to JobQuest365.com Website and JobQuest365.com Content are the exclusive property of JobQuest365.com or its licensors.

5.2 JobQuest365.com Website and JobQuest365.com Content are protected by copyright, trade mark, database right and other intellectual property rights laws in any part of the world.

5.3 You may retrieve and display JobQuest365.com. Content of the JobQuest365.com Website on a computer screen, store such content in electronic form on disk (but not on any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact any and all copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the content or materials on the JobQuest365.com Website without written permission from JobQuest365.com.
