1. Introduction

1.1 Egalite Marketing Pte. Ltd. are the owners of the JobQuest 365 Websites [hereinafter ‘Our Websites’]. Our Websites may be used by all Users subject to their acceptance of our Website Legal Terms which consists of Our Website User Agreement [Click here], Our Privacy Policy [Click here], and Our Acceptable Use Policy [Click here].

1.2 In addition to Our Website Legal Terms [specified in Clause 1.1 hereinabove], as a Candidate, You are also bound by the Candidate Agreement [this Agreement].

1.3 We may revise, change, supplement or amend [collectively ‘revise’, or variants thereof] Our Website Legal Terms and Our Candidate Agreement as they relate to Your use of Our Websites and Our Services from time to time. Any and all such revisions are done by us by posting the revised documents on Our Websites. You hereby agree that all such revisions shall apply to Your use of Our Websites and of our Services from the date that such revision shall take effect.

2. Who is considered a Candidate

2.1 A Registered User (with Free Access or Premium Access) who is looking for employment or engagement in Jobs or Projects by Posting their Resumes, or for Tasks engagements on the JobQuest 365 Website Platforms.

3. Free Access and Premium Access Accounts

3.1 Registration - Free Access Account

3.1.1 To register on the JobQuest365.com Website, you must be sixteen (16) years of age or above.

3.1.2 You must ensure that the personal details provided by you on registration, or at any time thereafter, are full, correct and complete.

3.1.3 You must inform Us immediately of any changes to the information that you had provided when registering, by updating your personal details, in order for Us to communicate with you effectively.

3.1.4 You will be given access to "My Profile" and all "Tasks" related features of the JobQuest365.com Website.

3.2 Registration - Premium Access Account

3.2.1 To register on the JobQuest365.com Website you must be 16 years of age or above.

3.2.2 You must ensure that the personal details provided by you on registration, or at any time thereafter, are full, correct and complete.

3.2.3 You must inform Us immediately of any changes to the information that you provided when registering by updating your personal details, in order for Us to communicate with you effectively.

3.2.4 You MUST register as a Free Access User before upgrading your account to that of a Premium Access User.

3.2.5 To upgrade to the Premium Access Account, there will be a one-time fee charged to you of SGD3.00 (subjected to 7% GST in Singapore) or USD3.00 (for Foreign Persons) [the ‘Upgrade Fee’], which is payable by credit/debit card.

3.2.6 You will be given access to "My Profile", "My Resume", and all "Tasks", "Jobs", "Project" related features of JobQuest365.com Website.

3.2.7 JobQuest365.com reserves the right to change the Upgrade Fees for new Users, or institute new charges or fees, from time to time, as it deems appropriate.

4. Password and Security

4.1 When you register to use the JobQuest365.com Website with your email account, you will be asked to create a password. Alternatively, if you register with Facebook, you will be asked to login into your Facebook account. In order to prevent fraud, you must keep this password confidential and must not disclose or share it with anyone. You agree to immediately notify JobQuest365.com of any unauthorized use of your Account and password.

4.2 If JobQuest365.com has reason to believe that there is likely to be a breach of security or misuse of the JobQuest365.com Website, we may require you to change your password or we may suspend your Account.

4.3 As a result of the loss of your Password, or the misuse of the JobQuest365.com Website by You, You hereby agree that:

4.3.1. All loss, damage or expense incurred thereby shall be borne by You; and

4.3.2. You shall fully indemnify JobQuest365.com should JobQuest365.com suffer any loss, damage or expense as the result of Your actions.

5. Additional Terms applicable to Candidates

5.1 JobQuest365.com hereby grants you a limited, terminable, non-exclusive right to access and use the JobQuest365.com Website for your sole private use when seeking for employment.

5.2 You are responsible for maintaining the confidentiality of your Candidate account, Profile and passwords, as applicable.

5.3 You may not share your password or other account access information with any other party, and you shall be strictly liable and/or responsible for all uses of your JobQuest365.com Website registrations and passwords, whether or not authorized by you.

5.4 You agree to immediately notify JobQuest365.com of any unauthorized use of your Candidate account, Profile or passwords.

5.5 The Candidate represents, warrants and covenants that any and all Candidate Materials [including their Resume] provided by the Candidate for use in connection with JobQuest365.com Services will not violate any laws or regulations or third-party proprietary rights, including, without limitation, copyright and trade mark laws, obscenity, rights or publicity, privacy, and defamation laws.

5.6 The Candidate acknowledges and agrees that he shall disregard any personal data received from Employers which are irrelevant to obtaining and assessing the suitability of the employment/engagement of the Candidate.

5.7 The Candidate is solely responsible for the Candidate Materials posted on the JobQuest365.com Website. The Candidate agrees that JobQuest365.com shall not be responsible for any employment decisions, for whatever reasons, made by the Candidate when the Candidate post any Task engagement posting on any JobQuest365.com Website.

5.8 Candidate Materials (including the Resume posted by the Candidate) shall not contain:-

5.8.1 misleading, unreadable, or “hidden” keywords, repeated keywords or keywords that are irrelevant to the Tasks opportunity being presented;

5.8.2 names, logos or trademarks of unaffiliated companies;

5.8.3 inaccurate, false, or misleading information; and

5.8.4 material or links to material that is discriminatory, pornographic, sexually explicit, obscene, libelous, defamatory, threatening, harassing, abusive, or hateful, or solicits personal information from anyone under 18.

5.9 You may not use your Candidate Materials to:-

5.9.1 post Tasks in a manner that does not comply with applicable local or national laws, including but not limited to laws relating to labor and employment, equal employment opportunity, employment eligibility requirements, data privacy, data access, date use, and intellectual property;

5.9.2 sell, promote or advertise third party products or services;

5.9.3 post any materials which relates to a franchise scheme, pyramid scheme, the sale or distributorship of third party products or services, or of a multi-level marketing opportunity;

5.9.4 promote any opportunity that does not represent a bona fide Task Opportunity; and

5.9.5 advertise sexual services or seek employees for jobs or tasks of a sexual nature.

5.10 JobQuest365.com does not allow any Employer Materials on JobQuest365.com Website that requires the prospective Candidates to pay any monies, including any alleged deposits, placement fees, processing fees or any other similar fees, directly or indirectly, and/or which requires The Candidates to make purchases of any third party Products or Services from any person. Candidates are strictly advised to exercise caution and not to pay any person any monies for an alleged Task opportunity. Where any such demand is made of a Candidate, the Candidate should raise this issue with our Customer Service Department through email at: [email protected]

5.11 JobQuest365.com does not allow recruitment advertisements that advertises more than one Job opportunity in a single posting.

5.12 Though JobQuest365.com is under no obligation to monitor the Candidate Materials on JobQuest365.com Website, JobQuest365.com may monitor the Candidate Materials at random.

5.13 JobQuest365.com reserves the right to remove any Candidate Materials or content from any JobQuest365.com Website, which in the reasonable exercise of JobQuest365.com’s discretion, does not comply with this Section, or of any content posted that JobQuest365.com believes is not in the best interest of JobQuest365.com.

5.14 Reposting for the same position is allowed only after the post has expired to minimize duplication and spamming of recruitment postings on the JobQuest365.com Websites.

5.15 Job recruitment postings will expire 14 days after the posted date.

5.16 Project and Task recruitment postings will expire on the following day after the "Start Date" of the post.

5.17 If any time during your use of the JobQuest365.com Services, you made a misrepresentation of fact to JobQuest365.com, or otherwise misled JobQuest365.com regarding the nature of your activities, or You breach the Terms herein, JobQuest365.com may terminate your use of your JobQuest365.com Account, and in all such events, any payment made by you shall be forfeited.

5.18 You understand and acknowledge that if you cancel your Candidate Account or your Candidate Account is terminated, all your account information on JobQuest365.com, including saved Content and Materials, will be deleted from the JobQuest365.com Databases. Information may continue to be available for some period of time because of delays in processing such deletion and cancellation on the JobQues365.com’s web servers.

5.19 Express Consent and Acknowledgement

5.19.1 By accepting the option, "I agree and consent to JobQuest365.com releasing my Resume." stated in MY RESUME, I acknowledge, understand and agree that when submitting my Resume for storage in your Resume Database, my Resume is automatically searchable by Employers who are subscribers of our Resume Database. I hereby agree that JobQuest365.com is not responsible for the improper or illegal use made of Resumes by Employers despite the fact that such use is in breach of their Terms and Conditions of use.

5.19.2 Additionally, I acknowledge, understand and agree that when my Resume is displayed in the Resume Database, my personal information which is present within my Resume (such as my email address), can be collected and used by third parties other than Employers. This may result in my receiving unsolicited messages from third parties for which JobQuest365.com shall not be held responsible. I hereby acknowledge, understand and agree that JobQuest365.com exercises all reasonable endeavors to limit access to its Resume Database to Employers only, but it cannot guarantee that other third parties will not gain access to the Resume Database.

5.19.3 I acknowledge understand and agree that, though I may remove my Resume from your Websites at any time, Employers who had previously gained access to our Resume Database may have retained a copy of my Resume in their own files or databases. I acknowledge, understand and agree that JobQuest365.com is not responsible for the unauthorized retention or use of my Resume in such circumstances, which are outside the control of JobQuest365.com.

6. Intellectual Property

6.1 JobQuest365.com Website, JobQuest365.com Content, and all right, title and interest in and to JobQuest365.com Website and JobQuest365.com Content are the exclusive property of JobQuest365.com or its licensors.

6.2 JobQuest365.com Website and JobQuest365.com Content are protected by copyright, trade mark, database right and other intellectual property rights laws in any part of the world.

6.3 You may retrieve and display JobQuest365.com. Content of the JobQuest365.com Website on a computer screen, store such content in electronic form on disk (but not on any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact any and all copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the content or materials on the JobQuest365.com Website without written permission from JobQuest365.com.
