Acceptance of Use Policy

1.1 This Acceptable Use Policy applies to all Users of any of Our Websites.
1.2 You the User hereby agree that when you access or use any of Our Websites, this Acceptable Use Policy shall apply to You,
1.4 If you are a Candidate or Employer, in addition to Our Website Legal Terms [referred to in Clause 1.3 hereinabove] you are also bound by the Candidate Agreement [Click here] or Employer Agreement [Click here] as is applicable to You.
2. Prohibited Uses
If you are under the age of Sixteen , you may use Our Websites only with the express approval of a parent or guardian. You may not use Our Websites or our Services if you do not have the legal capacity to enter into a contract in accordance with the applicable laws of Singapore.
2.1 You the User hereby undertake that You shall use Our Websites only for lawful purposes.
2.2 You Shall not use Our Websites:
2.2.1. If You do not have the legal capacity to enter into binding contracts for any reasons whatsoever [such as that You are a minor, or are of unsound mind].
2.2.2. If, being an individual, You are not, at least, sixteen  years of age.
2.2.3. For the purpose of harming or attempting to harm any person, including minors.
2.2.4. In any way that breaches any applicable local, national or international laws (including, but not limited to the Data Protection laws currently in force, and as from time to time amended, revised or updated). In connection therewith, you hereby acknowledge and agree that you shall not use Our websites for any unlawful, illegal, deceitful, criminal or fraudulent purpose, or which has any unlawful or fraudulent purpose, objective or effect.
2.2.5. To send, knowingly receive, upload, download, use or re-use any content or material which does not comply with our Content Standards as described below.
2.2.6. To transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional materials, or any other forms of similar solicitation (such as spam).
2.2.7. To knowingly transmit any data, or to send or upload any content or materials that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code, designed to adversely affect the operation of any computer, software, hardware system or server system, of any other persons or entity, including Us.
2.3 You also undertake and agree:
2.3.1. Not to reproduce, duplicate, copy or re-sell any part of Our Websites in contravention of the provisions of our Website Legal Terms.
2.3.2. Not to access, without authority, interfere with, damage or disrupt: any part of Our Websites; any equipment or network on which Our Websites or our data are stored; any software used in the provision of the Services offered or provided on Our Websites; or any equipment or network or software owned or used by any third party.
3. Interactive Services
3.1 We may from time to time provide interactive services on any of Our Websites, including, without limitation:
3.1.1. Chat Facilities.
3.1.2. Web-based Emails.
3.1.4. Social Media Platforms.
(hereafter "Interactive Services").
3.2 As and When We provide any Interactive Services, We will specify the rules pertaining to the types of Interactive Services offered, and whether it is moderated or un-moderated. And, if it is moderated, the form of moderation that will be employed (including, whether it is human or technical).
3.3 We will exercise our best efforts to assess and judge any possible risks for Users from third parties when they use any Interactive Service provided on any of Our Websites, and we will decide in each case whether it is appropriate to use moderation on the relevant Interactive Service (including the type of moderation to be used) in light of those risks.
3.4 You hereby accept that we are under no obligation to oversee, monitor or moderate any Interactive Service we provide on any of Our Websites, and we shall not be held responsible or liable for any harm, loss or damage arising from the use of any Interactive Service by a User, and whether the Service is moderated or not.
3.5 The use of any of our Interactive Services by a minor is subject to the consent of their parents or legal guardian. We advise parents who permit their children to use an Interactive Service that it is important that they communicate with their children about their safety online, as moderation cannot be fool-proof and is subject to the risks of abuse. Minors who are using any Interactive Service should be made aware of the potential risks to them.
3.6 In cases where we do moderate an Interactive Service, we will provide to You a means of contacting the Moderator, should a concern or difficulty arise which you seek addressed. 4. Content Standards
4.1 These Content Standards apply to any and all content and materials which You contribute to Our Websites ("Contributions"), and to any Interactive Services associated with it.
4.2 You must comply with the spirit of the following standards, as well as the letter of the rules here expressed. The standards are intended to apply to all parts of any Contribution contributed by all Users.
4.3 The Contributions shall:
4.3.1. Be accurate (where they state facts).
4.3.2. Be genuinely held (where they state opinions).
4.3.3. Comply and abide with the laws of both the country where the User is accessing the website, and in any country from or to which the Contributions are posted [if the latter is in a different country].
4.4 The Contributions must not:
4.4.1. Contain any material which is libelous or defamatory of any person.
4.4.2. Contain any material which is obscene, offensive, hateful or inflammatory.
4.4.3. Display or Promote sexually explicit or offensive material, including acts of violence of any sort.
4.4.4. Promote discrimination or prejudice based on race, ethnicity, sex, religion, nationality, disability, sexual orientation or age.
4.4.5. Infringe any intellectual property or intellectual property rights of any other person.
4.4.6. Be made in breach of any legal duty owed to a third party, such as a contractual duty to keep or maintain certain information secret or confidential [including trade secrets].
4.4.7. Be threatening, abusive or invasive of another person’s privacy, or causing annoyance, inconvenience or needless anxiety to another person.
4.4.8. Be likely to harass, upset, embarrass, alarm or annoy any person.
4.4.9. Be used to impersonate any person, or to misrepresent the identity of the contributor with some other person.
4.4.10. Give the impression that they emanate from Us, if this is not the case.
4.4.11. Advocate, promote or assist any unlawful or illegal act or wrong [whether a civil or a criminal wrong], such as infringing intellectual property rights of a third party or any form of computer misuse [or abuse].
5. Suspension and Termination
5.1 You hereby agree that your failure, refusal or neglect to comply with any of the terms of Our Acceptable Use Policy shall constitute a material breach of the Website Legal Terms upon which You are permitted to use Our Websites, and may result in Our taking any or all of the following actions:
5.1.1. An immediate, temporary or permanent withdrawal of Your right to use any or all of Our Websites or Our Services [including Our interactive Services].
5.1.2. An immediate, temporary or permanent removal of any posting or material uploaded by You to any of Our websites.
5.1.3. The issue of a warning to You.
5.1.4. The institution of Legal proceedings against You, for reimbursement of all costs and expenses on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from any breach by You, which causes loss, damage and/or expense to Us.
5.1.5. Further legal action against you to protect or enforce our legal rights.
5.1.6. Our disclosure of information to law enforcement or Regulatory Authorities in any country [including where you reside or where you use your computer] which we, in our sole discretion, deem as necessary or as warranted.
5.2 You hereby agree that We shall not be held responsible or liable to You for actions taken by Us in response to Your breaches of this Acceptable Use Policy. The responses described in this policy are not limited to the aforesaid responses, and we may take all other actions we deem is proper or appropriate to protect Our rights or the rights of innocent Users and Third Parties.
6. Changes to This Acceptable Use Policy
We may revise, change, supplement or amend [collectively ‘revise’ or variants thereof] Our Website Legal Terms including this Acceptable Use Policy as they relate to Your use of Our Websites or its Services from time to time. Any and all such revisions are done by us by posting the revised documents on Our Websites. You hereby agree that all such revisions shall apply to Your use of Our Websites from the date that such revision shall take effect.
